1. Introduction

This document governs the terms and conditions of using GarirNilam, including all services, features, and content offered.

2. Acceptance of Terms

By accessing or using our website, users agree to comply with these terms and conditions. If you do not agree, please do not use our services.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use GarirNilam. By using our service, you represent that you meet these requirements and that the information you provide is accurate and complete.

4. Registration and User Accounts

Users must register an account to participate in auctions. Users are responsible for maintaining the confidentiality of their account information and agree to accept responsibility for all activities that occur under their account.

5. Auction Process

We facilitate the auction of vehicles and other related items. All vehicles are sold on an "as-is" basis without any warranties, unless otherwise specified. Bidding increments, auction duration, and other terms are at the discretion of GarirNilam.

6. Bidding and Purchasing

Users agree that placing a bid is a binding contract to purchase the item. The highest bidder at the auction's closing time is the winning bidder. Winning bidders must complete the purchase as per the specified terms.

7. Payment

Buyers are required to pay the winning bid amount plus the platform fee (5,000 BDT, non-negotiable and non-refundable) and any other applicable fees within a specified timeframe. We may charge the buyer's saved payment methods (e.g. saved cards or bank accounts) for the winning bid, platform fee, and other applicable fees when they win. Failure to make timely payments may result in penalties or suspension of the user account.

8. Commission and Fees

Buyers must pay a flat platform fee of 5,000 BDT per winning bid. This fee is non-negotiable, non-refundable, and mandatory for every winning bidder. Sellers pay a tiered commission on the hammer price (see Pricing & Fees). No listing fee.

We may offer discounts on fees from time to time. Contact us or check promotions for details.

9. Buyer Default

If the winning bidder fails to pay the winning bid amount plus the platform fee (5,000 BDT, mandatory and non-refundable) and any other applicable fees within the specified timeframe, GarirNilam may treat the sale as cancelled. We may charge the buyer's saved payment methods for any outstanding amount. The buyer may forfeit any deposit or escrow paid; late payment fees may apply as set out in our fee structure. The vehicle may be relisted or offered to the next highest bidder at GarirNilam's discretion. The defaulting buyer may face account suspension or other action.

10. Reserve and Cancellation

Some auctions have a reserve price. If the reserve is not met by the auction end, the seller is not obliged to sell and the auction may close without a sale. GarirNilam or the seller may cancel or withdraw an auction in limited circumstances (e.g. listing error, breach of terms, or other valid reason). Where an auction is cancelled, we will not charge seller commission for that sale; any applicable fees already paid may be handled as set out in our Refund Policy or as we otherwise communicate.

11. Escrow

Where an auction requires or offers escrow (a deposit held until the transaction is completed), the escrow amount and terms are set per auction or in a separate policy. By participating in such an auction, you agree to the applicable escrow terms. Escrow may be released to the seller upon completion or returned to the buyer in case of cancellation, as per the terms for that auction.

12. Add-on Services & Other Charges

Title transfer, delivery, and professional photography are add-on services. Charges vary by service and location; contact us for a quote. The following may also apply:

Add-on services (each has its own charges):

Title / paperwork transfer: BDT 1,000 - BDT 3,000
Delivery: Own charges - contact for quote
Storage (per day after pickup deadline): BDT 200 - BDT 500 per day
Late payment fee: BDT 1,000 flat

12A. Referral Program

Referral rewards are only earned for completed transactions on Garir Nilam. Signing up with a referral code alone does not create an immediate payout.

Buyer referral: if the referred customer wins a car and completes payment on Garir Nilam, the referrer reward is 0.5% of the platform profit earned from that completed transaction.
Seller referral: if the referred customer sells a car and that sale is completed on Garir Nilam, the referrer reward is 1% of the platform profit earned from that completed sale.
Rewards are calculated after Garir Nilam records the completed transaction and associated platform revenue.
Each referred signup is eligible for one referral reward based on the first qualifying completed transaction processed on-platform.

13. Ownership and Transfer of Title

Ownership of the vehicle transfers from the seller to the buyer upon successful completion of the transaction. GarirNilam is not responsible for the transfer of title or any associated paperwork.

14. Dispute Resolution

Any disputes arising from the auction process should be resolved between the involved parties. GarirNilam is not responsible for disputes between users.

15. Seller Responsibilities

Sellers are responsible for the accuracy of listing information, including the vehicle's condition, history, and title status. The seller must have the legal right and authority to sell the vehicle. Misrepresentation may result in listing removal, account action, and liability to the buyer.

16. Prohibited Conduct

Users must not engage in shill bidding (fake bids to inflate price), fraud, false or misleading listings, or any activity that undermines the integrity of the auction. We may suspend or terminate accounts and take other action as we deem appropriate.

17. Limitation of Liability

GarirNilam is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.

18. Termination

We reserve the right to suspend or terminate user accounts for violations of these terms or for any reason deemed appropriate.

19. Changes to Terms and Conditions

We reserve the right to modify or update these terms and conditions at any time. Users are responsible for reviewing changes periodically.

20. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Bangladesh.

22. Other Policies

Use of GarirNilam is also subject to our Privacy Policy , Refund Policy , and Escrow Policy , which are incorporated by reference.

23. Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

24. Entire Agreement

These terms and conditions, together with the Privacy Policy, Refund Policy, and any other policies or rules referred to herein, constitute the entire agreement between you and GarirNilam regarding the use of our services and supersede any prior agreements or understandings.
